My practice builds upon specialized expertise with the major CAPL documents, hands-on experience with complex agreements in conventional, unconventional and frontier operating environments and the diverse real-world operational issues to which I have been exposed over time.
It is designed primarily to help clients optimize commercial outcomes for a particular project on a cost-effective basis, rather than being a more traditional practice focused on more typical day-to-day land activities.
The most likely client will be an E&P company that engages me to supplement internal land resources on a temporary basis with respect to a particular agreement or operational issue or to provide internal training.
However, my involvement in the creation of the major CAPL documents and the operational perspective I offer can also be of potential benefit to a law firm as a supplementary resource for a particular project for which it has been engaged.

Assistance with the assessment and resolution of issues under land agreements (particularly with respect to the CAPL documents), possibly in an early stage informal “referee” type role.

Review and optimization of precedents to align to the most recent CAPL Operating Procedure and CAPL Farmout & Royalty Procedure.
Preparation of WCSB land agreements with unusual elements, particularly for clients not yet familiar with the most recent CAPL Operating Procedure and CAPL Farmout & Royalty Procedure.

Expert witness opinions in the context of potential litigation.
Sounding board/Objective reviewer
Potential sounding board, “objective reviewer” role with respect to an agreement a company or law firm is preparing for a conventional, unconventional, frontier or international project. Potential secondary resource for oil sands agreements and possibly mining agreements with respect to specific concepts that are analogous to content in the CAPL Operating Procedure.
Training & development
Delivery of internal training with respect to the CAPL Operating Procedure, the CAPL Farmout & Royalty Procedure or the CAPL Property Transfer Procedure.
